Pedestrian Accident Settlement Calculator

Estimate a pedestrian accident claim after being hit by a vehicle, with your state’s fault rule, the driver’s insurance and your own auto coverage applied.

A rough estimate, not a prediction or an offer. Real settlements depend on the facts, the insurance available and negotiation. Talk to a personal injury attorney about your case.

Pedestrians can claim against the driver and their own policy

A pedestrian hit by a car claims against the driver’s liability insurance like any other crash victim. Your own auto policy usually still helps even though you were on foot: PIP in no-fault states, MedPay in others, and uninsured or underinsured motorist coverage if the driver has too little insurance or drives off.

Crosswalks do not settle fault on their own

Drivers must yield to pedestrians in marked and unmarked crosswalks in every state, but insurers still look at where you crossed, the signal, lighting and whether you were distracted. Under your state’s fault rule, a share of blame reduces the claim and can bar it in contributory negligence states. In DC, pedestrians and cyclists can recover unless they were more at fault than the driver.

Injuries are often serious

With no protection, pedestrians suffer leg and pelvic fractures, head injuries and long recoveries. That pushes claims toward the higher multipliers, and also makes it more likely the driver’s policy limit becomes the ceiling. The calculator adds your UM/UIM coverage to show the realistic maximum.

Hit-and-run crashes

If the driver leaves, report it to police at once. Your uninsured motorist coverage usually treats a hit-and-run driver as uninsured, but many policies require a police report within a short time.

Questions people ask

Does my car insurance cover me if I was hit while walking?

Usually yes. PIP or MedPay can pay medical bills, and UM/UIM coverage can pay for injuries when the driver is uninsured, underinsured or unknown.

Can I recover if I was jaywalking?

Often yes, but your share of fault reduces the award. In contributory negligence states, any fault can bar the claim, so the evidence matters a great deal.
