What these deadlines mean
The statute of limitations is the last day to file a lawsuit in court. It is not a deadline to settle, and talking to an insurer does not pause it. If the date passes, the court will almost always dismiss the case.
Exceptions that change the date
- Discovery rule: some injuries are not known at once, and the clock may start when they are discovered
- Minors: many states pause the deadline until an injured child turns 18
- Government claims: a written notice of claim is usually due within months
- Medical malpractice: often has its own shorter deadline and an outer limit (statute of repose)
Recent changes
Florida cut its negligence deadline from four years to two for claims arising after March 24, 2023. Louisiana raised its deadline from one year to two for injuries on or after July 1, 2024.
