Is My Settlement Offer Fair?

Enter an insurer’s settlement offer next to your bills and injury to see where it falls in your state’s estimated range, with a counteroffer figure and walk-away floor.

A rough estimate, not a prediction or an offer. Real settlements depend on the facts, the insurance available and negotiation. Talk to a personal injury attorney about your case.

How to judge an offer

An offer is fair if it sits within the range a jury in your state would likely award, adjusted for the risks of trial and limited by the insurance available. The calculator builds that range from your medical bills, lost income and injury severity, applies your state’s fault rule and caps, then shows where the offer lands.

Why first offers run low

Adjusters expect to negotiate. A first offer often covers medical bills and little more, especially before your treatment ends. Insurers also count on people needing money quickly. A low first offer is not a final answer.

Before you accept

  • Make sure treatment is finished or your doctor has estimated future care
  • Add up every bill, including those paid by health insurance, which may need repaying
  • Check the filing deadline so you do not lose leverage while negotiating
  • Read the release: once signed, the claim is closed for good

How to respond

Reply in writing with a counteroffer and the reasons for it: the bills, the treatment, the effect on your life and the evidence of fault. Then use the counteroffer calculator to plan each step down, or start with a demand letter if you have not sent one.

Questions people ask

Should I accept the first settlement offer?

Rarely. First offers are usually opening positions. Compare the offer with your estimated range and counter in writing.

Can I reopen a claim after accepting a settlement?

Almost never. A signed release ends the claim, even if your injury later turns out to be worse.

How long do insurers take to respond to a counteroffer?

Usually days to a few weeks. Many states require insurers to respond within set times under fair claims practices rules.
