What a wrongful death claim pays for

A wrongful death claim compensates the family for what they lost when someone died because of another’s negligence. Most states allow:

  • Lost financial support: the income the person would have earned and spent on the family
  • Household services: childcare, chores, repairs and other work the person did
  • Final expenses: medical bills from the final injury, funeral and burial costs
  • Loss of companionship, care and guidance for a spouse, children and sometimes parents

Many states also allow a separate survival claim for the person’s own pain before death and their estate’s losses.

How future losses are valued

Economists project the person’s earnings to retirement, subtract what they would have spent on themselves, and discount the result to today’s value, because money received now can be invested. The calculator uses a 3% discount rate and lets you set the personal consumption share, commonly 20% to 40% depending on family size.

Who can file and when

State law decides who brings the claim, usually the personal representative of the estate on behalf of the spouse, children or parents. The filing deadline usually runs from the date of death and is often two or three years, but can be as short as one. Enter the date in the calculator to see your state’s deadline.

Limits that can apply

A few states cap non-economic damages in death cases, and the at-fault party’s insurance limit often sets the practical ceiling. A death claim against a government agency can face both caps and short notice deadlines.
